TERMS AND CONDITIONS FOR ACCOMMODATION CONTRACTS

[Scope of Application]

Article 1.
Contracts for Accommodation and related agreements to be entered into between our accommodation and the Guest to be accommodated shall be subject to these Terms and Conditions. And any particulars not provide for hearin shall be governd by laws and regulation and/or generally accepted practices.
 
2.In the case when the Accommodation has entered into a special contract with the Guest insofar as such special contract dose not violate laws and regulations and generally accepted practices, notwithstanding the preceding Paragraph, the special contract shall take precedence over
the provisions of those Terms and Conditions.

[Application for Accommodation Contracts]

Article 2.
A Guest who intends to make an application for an Accommodation
Contract with the Accommodation shall notify the Accommodation of the following particulars:
⑴ Name of the Guest(s);
⑵ Date of accommodation and estimated time of arrival;
⑶ Name of the person making the application and his/her contact information, and name and contact information of the person paying for the accommodation; and
⑷ Other particulars deemed necessary by the Accommodation.
 
2.In the case when the Guest requests,during his stay,extension of the accommodation beyond the date in subparagraph ⑵ of the preceding Paragraph, in the event that there is no reservation at this facility, a new application for a contract of accommodation will be deemed to have been made when such an offer is made, the facility accepts the application, and the accommodation charge is paid in advance.

[Payment of Reservation Deposit]

Article 3.
The person making a reservation for accommodation as described in the preceding article shall pay a deposit of 30,000 yen within 7 days from the day following the day of application, by the method designated by the accommodation. Bank transfer charges shall be borne by the guest.
2. The deposit in the preceding paragraph shall be 30,000 yen (for one night) only, even if the guest applies for consecutive nights.
3. The deposit shall first be allocated to the room charge ultimately payable by the guest, and in the event that the provisions of Articles 7 and 19 apply, the deposit shall be allocated in the order of cancellation charge followed by compensation, and any remaining amount shall be returned upon payment of the charge in accordance with the provisions of Article 12.

[ConcIusion of Accommodation Contracts,etc.]

Article 4.
The accommodation contract shall be concluded when the accommodation confirms the payment of the deposit as described in the preceding article. The order of establishment of the accommodation contract shall be in accordance with the order of acceptance of accommodation reservations as stipulated in Article 2.
2. In the event that the deposit is not paid by the date stipulated in Article 3-1, this accommodation shall treat the accommodation reservation as not having been made.
3. Once an accommodation contract has been established, the accommodation date cannot be changed thereafter. In the event that the accommodation date is changed for the convenience of the guest, the accommodation contract shall be cancelled once and the guest shall make a new accommodation reservation in accordance with the cancellation of the accommodation contract stipulated in Article 7.

[Special Contracts Requiring No Accommodation Deposit]

Article 5.
Notwithstanding the provisions of Article 3, the accommodation may accept a special agreement not to require payment of the deposit.

[Refusal of Accommodation Contracts]

Article 6. The Accommodation may not accept the conclusion of an Accommodation Contract under any of the following cases:
(1) When the application for accommodation does not conform with the provisions of these Terms and Conditions:
(2) When the Hotle is fully booked and no room is available;
(3) When the Guest seeking accommodation is deemed liable to conduct himself in a manner that will contravene the laws or act against the public order or good morals in regard to his accommodation;
(4) When it is recognized that the person who intends to stay falls under any of the following items (a) through (c).
 (a)When the Guest seeking accommodation is in a gang, a gang member,or is part of or related to an organization associated with gangs;
 (b)When the Guest seeking accommodation is associated with a corporation or organization whose board members or members are identified as gangsters and who control business;
 (c)When the Guest seeking accommodation is part or a member of an antisocial group that threatens the order and safety of society;
(5) When the person seeking accommodation has said or done something that causes significant inconvenience to other guests.
(6) When the Guest seeking accommodation can be clearly detecte as carrying an infectious disease;
(7) When the Guest seeking accommodation acts makes violent demands or when the Accommodation is requested to assume an unreasonable burden in regard to his accommodation;
(8) When the Hotel is unable to provide accommodation due to natural calamities, disfunction of the accommodation and/or other unavoidable causes;
(9) When the Guest seeking accommodadtion, owing to heavy infoxication or other ewasons, is liable to caus annoyance to other guests and/or, in fact, conducts himself in a disorderly manner and disturbs or annoys other guests.
(10) When the Guest seeking accommodadtion brings in hazardous materials (firearms such as stoves, petroleum, firearms) or items harmful to the human body.
(11) If the case falls under the provisions of Article 5 of the Kyoto Prefecture Ordinance for Enforcement of the Ryokan Business Law.
(12) When the applicant is a person to whom Article 10 has been applied in the past.

[Right to Cancel Accommodation Contracts by the Guest]

Article 7.
The Guest is entitled to cancel the Accommodation Contract by notifying the Accommodation.
2. In the event that the accommodation reservation applicant cancels all or part of the accommodation reservation (including meals, foodstuffs, services, and purchase of goods reserved in advance), a penalty charge shall be applied as follows.
(except in the case where this facility specifies the date for payment of the deposit and requires such payment in accordance with Article 3-1, and the guest cancels the accommodation reservation prior to such payment)

(a) In case of cancellation on the day of stay, 100% of the room charge will be applied for the basic room charge and each additional person, 70% for cancellation on the day before, 50% from 4 to 2 days before, 30% from 7 to 5 days before, 20% from 14 days before, and 10% from 30 days before. However, if different cancellation fees are set for a particular plan, the cancellation fee set for the plan shall prevail.
(b) When a guest does not arrive at the hotel by 8:00 p.m. on the day of stay or does not contact the hotel more than 2 hours after the scheduled arrival time (8:00 p.m. being the limit of delay), the reservation shall be deemed to have been cancelled by the applicant, and the reservation may be treated as cancelled on the day of stay.
(c) In the event that the number of reserved days has been shortened, a penalty fee will be collected based on a penalty ratio of 1 day (the first day), regardless of the number of days shortened.
(d) In the event that the reservation is deemed to have been cancelled pursuant to the preceding paragraph, if it is proven that the non-arrival or delay of a train, aircraft, or other public transportation, or any other reason not attributable to the guest, is the reason for the guest's failure to contact the accommodation facility, the penalty fee stipulated in paragraph 1 shall not be charged. However, this shall only apply when the guest has contacted the accommodation.

Cancellation charge for Accommodation


Attention. The % is the ratio of the cancellation fee to the room charge (Attachment 1).
 
When the number of days contracted is shortened, the cancellation charge for the first day of the cancelled period shall be paid by the Guest regardless of the number of days shortened.

[Registration]

Article 8.
The guest shall register the following particulars at the "Check-in center" on the day of accommodation.
(1) Name, date of birth, sex, address and occupation of the guest(s).
(2) For non-Japanese Guest(s); nationality,passport number, port anddate of entry into Japan, and place of stay if the guest will be staying before or after his/her arrival;
(3) In the case of a foreign national who does not have an address in Japan, a copy of his/her passport in addition to the provisions of the preceding item
(4) Date and esimated time of departure; 
(5) Names of accompanying persons; and
(6) Any other information deemed necessary by the facility.

2. Foreigners who do not have a domicile in Japan will be required to present and make a copy of their passport.

[Occupancy Hours of Guest Rooms]

Article 9.
Guests may enter the accommodation between 3:00 p.m. and 7:00 p.m. (check-in time), with an additional charge for check-in after 7:00 p.m.Check-out time is by 10:00 a.m.

The Accommodation may, notwithstanding the provisions prescribed in the preceding Paragraph, permit the Guest to occupy the facility beyond the time prescribed in the same Paragraph. In the case, extra change shall be paid as follows:
 
(1) Early check-in fee
From 1:00 p.m. to 3:00 p.m. 7,000 yen or 5,000 yen per hour
(2) Late check-in fee
From 7:00 p.m. to 10:00 p.m.: 10,000 yen
(3) Extended check-out time (late check-out)
7,000 yen per hour from 10:00 a.m. to 12:00 p.m.
Overnight stay charge will be applied after 12:00 p.m.




In the case when the Guest is accommodated continuously, the Guest may occupy it all day long, except for the days of arrival and departure.


[Right to cancel the contract of this accommodation]
Article 10.
This accommodation facility may cancel the accommodation contract in the following cases, even during the accepted period of stay
(1) When the guest falls under any of Article 6-3~12
(2) When a person other than the guest is allowed in the room
(3) When a guest does not follow the prohibitions of the rules of use (restricted to particulars deemed necessary in order to avoid the causing of fires) established by the facility, such as smoking in places other than the designated areas, sleeping in the bedroom, etc.
(4) When it is found that there is a false statement made by the guest with regard to the registration and information items concerning accommodation as stipulated in Article 8.

[Observance of Use Regulations]

Article 11.
The Guest shall observe the Use Regulations established by the Accommodation.

[Payment of Accommodation Charges]

Article 12.
The Accommodation charges that the Guest shall pay is as listed in the Attached Table No.1.
Accommodation Charges, etc. as stated in the preceding Paragraph shall be paid with Japanese currency or by any means other than Japanese currency such as accommodation vouchers or credit cards recognized by the Accommodation at the "Check-in center" at the time of the departure of the Guest or upon request by the Accommodation.
Accommodation Charges shall be paid even if the Guest voluntarily does not utilize the accommodation facilities provided for him by the Accommodation and which are at his disposal.

[LiabHities of the Accommodation]

Article 13.
The Accommodation shall compensate the Guest for the damage if the Accommodation has caused such damage to the Guest in the fulillment or the nonfulfillment of the Accommodation Contract and/or related agreements. However, the same shall not apply in cases when such damage has been caused due to reasons for which the Accommodation is not liable.

[Procedure when unable to provide Contracted contents]

Article 14.
When unable to provide contracted facility, the Accommodation shall arrange accommodation of the same standard elsewhere for the Guest insofar as practicable with the consent of the Guest.
When arrangement of other accommodation can not be made notwithstanding the provisions of the preceding Paragraph, the Accommodation shall pay the Guest a compensation fee equivalent to the cancellation charges and the compensation fee shall be applied to the reparations. However, When the Accommodation can not provide accommodation due to causes for which the Accommodation is not liable, the Accommodation shall not compensate the Guest.

[Handling of Deposited Articles]

Article 15.
This accommodation does not handle any deposit items. The Accommodation shall not be responsible for any loss, damage, or other loss of or damage to any items, cash, or valuables brought into the facility by guests.

[Custody of Baggage and/or Belongings of the Guest]

Article 16.
Valuables, with the exception of guests' baggage, etc., cannot be received or stored prior to the stay.
If a guest's baggage or personal belongings (including those in a safe) are left at the Accommodation after the guest has checked out, they will be kept at the accommodation for 7 days, including the day of discovery, after which valuables will be reported to the nearest police station and other items will be disposed of.

[LiabiIity in Regard to Parking]

Article 17.
The accommodation has a free parking lot for guests; however, if a guest uses the parking lot on the premises of the hotel, the hotel shall be deemed to merely provide a space for parking and shall not be responsible for the storage of the guest's vehicle.

[Disclaimer]

Article 18.
Guests shall be responsible for their own use of computers and other communication devices in the Accommodation. The Accommodation shall not be liable for any damages incurred by guests as a result of service interruptions caused by system failures or other reasons when using computers or other communication devices.

[Liability of the Guest]

Article 19.
The Guest shall compensate the Accommodation for the damage caused through intention or negligence on the part of the Guest.
 
(1) The accommodation is not responsible for any accidents that occur due to the guest's failure to follow the rules of use posted by the facility.
(2) Please be sure to report any damage or defacement of fixtures, etc. caused by the intentional or negligent act of the guest. If you leave the room without reporting the damage, you will be charged for the full cost of repair or purchase of the same item. If you report such an incident, we will apply the equipment and fixtures insurance as much as possible.
(3) In the event that a guest vomits due to drunkenness, etc., soiling the bedding or facilities and rendering the guest room unusable, or in the event of damage to property in the guest room due to rough handling that is not normal, the guest will be charged for damages, including cleaning costs and business compensation fees incurred if business is lost during the period in which repairs are made.

[Jurisdiction and Applicable Laws]

Article 20.
Any dispute arising from or in relation to these Provisions shall be referred to the Japanese court having jurisdiction over the location of this Accommodation (the Kyoto District Court and the Kyoto Summary Court) and resolved in accordance with applicable Japanese laws.




Note:
・The basic charge and the additional charge are the amounts announced by the accommodation facility at the time of reservation.
・Infants stay free of charge (however, bedding and breakfast are not provided).

RULES ON USING ACCOMMODATIONS

In order to maintain the public nature and safety of the facility, guests are kindly requested to observe the rules, outlined in Article 11 of the Accommodation Contract.
If guests do not observe these rules, the Accommodation will be obliged to cancel their accommodations and the related contract as specified in Article10.

In principle, no one other than those registered to stay at the hotel is allowed to enter the facility. A room charge of the same amount will be applied for overnight stays, and a facility use fee will be applied for day use.
Do not use firearms in the facility, which may cause a fire.
Smoking is prohibited in the facility.
Since this is a wooden facility located in a residential area, please do not make others feel uncomfortable by loud singing, boisterous behavior, or any other behavior that may cause trouble to neighboring residents.
Do not bring the following items into the facility
(A) Animals and birds
(B) Items that emit a noticeably bad odor
(C) Items that are in a large quantity.
(D) Items that are likely to ignite or catch fire, such as gunpowder or volatile oil
(E) Firearms and swords that are not lawfully permitted to be possessed
(f) Marijuana, narcotics, stimulants, etc.
 
Do not engage in gambling or any other conduct that may be offensive to public morals in this facility.
Do not unnecessarily bring visitors into the facility, or move, process, or remove equipment or goods from the facility to another location, or use the facility for purposes other than those for which it was originally intended.
Do not attach foreign objects to the building or equipment of the facility, or move them to other places in the facility.
Guests who are intoxicated will not be allowed to use the baths.
Guests are requested to observe the following hours of operation, which have been established by the hotel and posted in the hotel. However, the hours may be changed temporarily when necessary or unavoidable. In such cases, the hotel will notify the guests by appropriate means.
(1) Front desk service hours: 8:30 a.m. to 5:30 p.m.
(2)Breakfast time: 8:00 a.m. in principle, but not necessarily (between 7:30 a.m. and 9:00 a.m.)
(3) Incidental service facility hours: 10:30 to 22:00
